株式会社アメーバホールディングス（以下「当社」という）は、当社が運営する「WEB会員サービス」（以下「本サービス」という）をお客様にご利用いただくため、 次の利用規約を設けさせていただいております。本規約に同意の上、かつ、本規約によりご利用いただきますようお願いいたします。

第1条（本サービスの定義）
1．本サービスとは、当社が運営しているウェブサイト（以下「ザ・タワーホテル・ナゴヤ ウェブサイト」という）上で、当社が提供する以下のサービスの総称をいいます。
(1) メールマガジン配信サービス
(2) WEB専用予約システムサービス
(3) 上記(1)、(2)に付随する会員ページ利用サービス
2．ただし、第1項(1)のサービスは、メールマガジン配信を希望された方のみに、メールマガジンを配信します。

第2条（基本的事項の遵守）
1．本サービスのご利用に際し、お客様にはインターネット利用の一般的マナー、モラルおよび技術的なルール、その他日本国の法令もしくは公序良俗を遵守していただきます。
2．有料の手配代行など、事由の如何を問わず、営利を目的として当システムを利用することは固くお断りいたします。

第3条（基本事項に反する場合の措置）
お客様がインターネットの利用により当社の名誉、信用その他当社に損害を与えたり、本サービスの運営に障害を与えたり、また、第三者に迷惑、不利益を与えたと当社が判断したときは、 本サービスおよび当社施設のご利用をお断りし、損害の賠償を求めることがあります。

第4条（本サービス利用者の条件）
本サービスを利用できるのは、本規約に同意いただいたお客様のみです。なお、本サービスを利用して第6条第1項が成立した時点で、本規約に同意いただいたとみなします。

第5条（お客様側の利用環境を要因とする諸影響）
1．本サービスは一般的な文字（日本語表示）や電子メール、プリンターなどの諸設定が適切になされている方を対象といたしております。この条件に当てはまらない方の動作結果やそれがもたらす諸影響に関して、当社は一切責任を負いません。
2．上項の条件を満たしていてもお客様のコンピューターに関する環境設定に関するすべての事情等、当社の管理の及ばない原因によって、本サービスが正しく作動しない場合につきましても、それらがもたらす影響に関し当社は一切責任を負いません。

第6条（WEB会員）
1．WEB会員とは、本規約に同意の上、本サービスの所定フォームから会員登録を申し込み、当社がこれを承認したお客様本人をいいます。
2．当社は、WEB会員として承認することを不適切と判断した場合、登録申請を承認しない場合があります。この場合、当社はその理由を希望のお客様に開示する義務を負いません。

第7条（会員情報登録）
1．本サービスを利用希望のお客様は、本サービスの所定フォームから当社の指定する方法に従い会員登録するものとします。
2．本サービスの登録フォームから登録される登録情報は、利用希望のお客様本人が責任をもって管理するものとします。

第8条（利用者の自己責任）
1．WEB会員が本サービスをご利用するにあたり、自ら行った行為およびご自身のメールアカウントによりなされた一切の行為およびその結果について、WEB会員ご自身の行為の有無、過失の有無を問わず、WEB会員はその責任を負うものとします。また、当社の過失に依る場合を除き、WEB会員が第三者に損害を与えた場合、WEB会員は自己の責任と負担において当該第三者との紛争を解決するものとします。
2．WEB会員が次の事項のいずれかに該当する行為により、当社および本サービスに損害を与えた場合、当社は当該利用者に対して被った全ての損害について賠償を請求出来るものとします。
(1)本規約、当社が別途定める宿泊約款またはご利用規約に違反した場合
(2)会員登録および予約にあたって、虚偽、不当な登録または申し込みを行った場合
(3)第三者に代わり、同人の承諾なく会員登録または予約の申し込みを行った場合
(4)有害なコンピュータープログラムの送信または書き込みを行った場合
(5)その他日本国内で法令に違反する行為を行った場合

第9条（本サービスへのログイン）
1．本サービスの利用は、お客様ご自身で設定されたIDとパスワードでログインを行ないます。
2．ID・パスワードをお忘れになった場合、問合せページより再設定を行えます。
3．本サービスのログイン機能は、一定期間ログインされた状態のままになります。本サービスのご利用が終了しましたら、ログアウトされることをお勧めします。

第10条（登録情報の変更）
1．登録情報に変更があった場合、WEB会員はすみやかに本サービスの会員情報ページの登録内容変更より内容変更を行うものとします。
2．登録情報の変更が行われず、そのことによりWEB会員本人様が何らかの不利益を負ったとしても、当社は一切の責任を負いません。

第11条（退会）
1．本サービスの退会を希望される場合、本サービスの会員情報ページより退会の手続きを行うことが出来ます。
2．上項において第1条1項(2)を利用して予約申し込みおよび予約中の場合、退会手続きを行なうことは出来ません。
3．退会手続き完了後は、WEB会員は本サービスが利用出来なくなります。

第12条（予約申し込み）
1．本サービスは、当社が第1条1項(2)を利用して提供する宿泊商品をインターネットで予約することが出来ます。
2．予約商品を所定フォームから予約申し込みする時は、必要な登録情報を正確に入力してください。予約申し込み入力内容に不備があった場合、予約が無効となる場合がございます。

第13条（予約の変更・取り消し）
1．本サービスを利用した予約の取り消しは、提供する予約商品の一部について、本サービスから取り消しが行えます。
2．予約の変更は、当社の予約担当窓口へ電話連絡にて行うものとします。

第14条（本サービスの注意点）
1．本サービスの提供する予約商品は、当社が提供する商品の一部の予約対象商品となります。宿泊プラン・空室状況・宿泊料金等は、他の方法（電話予約・予約取り扱い窓口など）で提供する予約・宿泊サービスと異なる場合もございます。
2．本サービスは、本サービス以外（電話予約・その他予約取り扱い窓口など）で提供するサービスに比べ、必ずしも優位性を持つものではありません。そのため、満室などの事由により予約出来ない場合もございます。

第15条（違約金）
当社は、利用者の責に帰すべき事由により予約が取り消された場合、当ホテル宿泊約款による違約金を申し受けます。詳細は、第1条1項(2)サイト内の「INFORMATION」でご確認いただき、当社の予約担当窓口へ電話連絡にてお問い合わせください。

第16条（個人情報の取り扱い）
1．当社は、WEB会員の個人情報を保護するため、個人情報に関するガイドライン（プライバシーポリシー）を設けます。
2．上項は、サイト内の「ザ・タワーホテル・ナゴヤ ウェブサイト プライバシーポリシー」に記載してあります。

第17条（本サービスの変更・廃止・改廃）
本サービスの運営、内容の変更・廃止・改廃については、当社が必要であると判断した場合、事前にお客様およびWEB会員に通知することなく実施する場合があります。

第18条（本規約の変更・廃止・改廃）
本規約、その他の定め等の制定・変更・廃止・改廃については、当社が必要であると判断した場合、事前にお客様およびWEB会員に通知することなく変更する場合があります。

第19条（一時的な利用中断）
当社は次の事項のいずれかに概当する場合、お客様およびWEB会員への事前の通知や承諾なしに本サービスの一時的な中断を行うことがあります。
1．本サービスのシステムの保守、または工事を行う場合。
2．天災、事変その他予期せぬ事態が発生し、または発生のおそれがあり運営が困難となった場合。
3．ザ・タワーホテル・ナゴヤ ウェブサイトおよび本サービス運営上またはその他理由で、本サービスの一時的な利用の中断が必要と判断した場合。
